Emerging Issue – Real Estate Law


In the case of Sleep Country Canada Holdings Inc. v. Canada (Attorney General), [2022] O.J. No. 4746, Sleep Country Holdings Canada issued an application to the court and sought a court order to rectify an agreement between Sleep Canada Holdings Inc and Sleep Country Canada Inc. The agreement was intended to affect a share exchange between the two entities. However, there were multiple errors in the body of these agreements/documents, and thus the parties sought a court order for rectification of those documents.
